Terms of Service

1. Acceptance of Terms

By creating an account or otherwise using SoSave ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

SoSave is a platform that digitizes community savings circles, Pardner, Susu, Tanda, Hui, Paluwagan, Chit Fund, and similar traditions. Members of a pool make scheduled contributions and take turns receiving the full pot. SoSave provides the software, payment infrastructure, identity verification, and custodial account handling that supports these flows.

3. Eligibility

• You must be at least 18 years old.
• You must be a legal resident of the United States or Jamaica.
• You must complete identity verification before participating in money movement.
• You must not be on any U.S. government sanctions list (OFAC SDN, etc.).

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access at hello@sosave.ai.

5. Payments and Custody

Contributions are collected from your linked bank account via ACH and held in custodial Financial Accounts operated by our partner, Stripe Treasury. Funds are disbursed to the designated recipient on the schedule established by the pool operator. SoSave is not a bank; we do not lend, invest, or otherwise use member funds for any purpose other than the agreed-upon pool payouts.

6. Fees

Basic use of SoSave is free for savers. Operators may be charged fees for premium features (Operator Pro). Pool completion may incur a small service fee. All applicable fees are disclosed in the app before you incur them.

7. SMS Messaging Terms

By providing your mobile phone number to SoSave, directly or by accepting a pool invitation that requires it, you consent to receive SMS, iMessage, and similar text messages from SoSave related to the operation of the service.

Types of messages

• Pool invitation messages sent on behalf of a pool operator.
• Pool reminders (a 24-hour reminder before an unaccepted invitation expires).
• Pool activity notifications (cycle opens, contribution receipts, payouts) subject to your notification preferences.
• Account security and verification notifications.

SoSave does not send marketing or promotional SMS messages.

Frequency

Approximately 1 to 10 messages per month per active pool, varying with your participation level and notification settings.

Carrier disclosure

Message and data rates may apply. Check with your mobile carrier for details.

Opt-out

Reply STOP to any SoSave SMS to opt out of future SMS communications. You may also disable SMS notifications in your account preferences at any time.

Supported carriers

SMS service is supported on all major US mobile carriers, including Verizon, AT&T, T-Mobile, and most regional carriers. Carriers are not liable for delayed or undelivered messages.

Service responsibility

SoSave is not responsible for messages that fail to deliver due to carrier outages, recipient device issues, recipient opt-out, or incorrect phone numbers. For SMS data handling, see the "SMS Communications and Mobile Numbers" section of our Privacy Policy.

8. Prohibited Use

You agree not to:

• Use the Service for any illegal purpose or to violate any law.
• Misrepresent your identity, location, or eligibility.
• Use the Service to launder money or finance unlawful activity.
• Attempt to reverse-engineer, scrape, or interfere with the Service.
• Use the Service to harass, defraud, or harm other users.

9. Termination

We may suspend or terminate your account if you violate these Terms, fail identity verification, or pose a risk to the integrity of the Service. You may close your account at any time, subject to settlement of any outstanding pool obligations.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, SoSave shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our aggregate liability shall not exceed the greater of (a) the fees you have paid to us in the twelve months preceding the claim or (b) one hundred U.S. dollars (US$100).

12. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be submitted to binding arbitration in Delaware, administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action.

13. Modifications

We may revise these Terms from time to time. The "Effective date" above reflects the latest revision. Material changes will be communicated via email or in-app notice at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles.
